Pro Wike Law Makers’ Deflection court Case in Portharcourt struck Out

The Federal High Court in Port Harcourt has struck out a suit filed by the Labour Party seeking to declare the seats of 27 Rivers State House of Assembly members vacant over their alleged defection from the PDP to the APC.

Justice Emmanuel A. Obile delivered the ruling on Tuesday. Martins Nwachukwu, aide to Speaker Martins Amaewhule—one of the key defendants—confirmed the decision via social media.

Defense counsel urged the court to dismiss the case, citing a recent Supreme Court ruling and presenting a Certified True Copy of the judgment. They argued the ruling affirmed Amaewhule’s leadership and noted that Governor Siminalayi Fubara had withdrawn similar allegations in a separate case in Abuja.

However, Labour Party counsel Clifford Chukwu maintained that the defection issue was a “collateral matter” and urged the court to proceed, citing evidence already submitted
